Kuching teen gets three-year stint in reform school for dishonestly retaining motorcycle

KUCHING (March 24): The Magistrates’ Court here today ordered a 15-year-old to be sent to Sekolah Tunas Bakti Kuching for three years after he pleaded guilty to dishonestly retaining a motorcycle belonging to a 55-year-old woman.

Magistrate Zubaidah Sharkawi imposed the sentence on the young offender after reviewing the Welfare Department’s (JKM) probation report.

The court also ordered for him to be placed under the supervision of JKM personnel for a year after he is released from the school.

The teenager was charged under Section 411 of the Penal Code, which provides for an imprisonment term of up to five years or a fine upon conviction.

He committed the offence at a house in Jalan Laruh around 5pm on Dec 5, 2022.

Based on the facts of the case, the owner of the motorcycle realised the bike, which had been parked at her house in Jalan Ajibah Abol, had gone missing.

The complainant then lodged a police report on the missing motorcycle, which was worth an estimated RM9,800.

Acting on information given, the police went to a house in Jalan Laruh on Dec 5, 2022 around 5pm and arrested the teenager.

He also showed police the motorcycle, which he had kept inside his house.

The chassis number of the motorcycle matched that of the complainant’s lost motorcycle.

Insp Nur Syafiqa Nyaie Ilin prosecuted the case, while the youth offender was unrepresented by counsel.
